California Opens Comments on Standard-of-Care and Self-Assessment Rules

California opened comments October 23 on proposed rules addressing self-assessments and the statutory standard-of-care model. The Board would repeal duplicative provisions and specified prescriptive furnishing protocols, and explains that self-assessment duties remain in statute. Comments are due December 7. No hearing is scheduled. The proposal follows legislation effective January 1, 2026. Pharmacy leaders should compare the draft with current procedures and distinguish this regulatory cleanup from the earlier statutory change.

Comment period opened October 23

The Board of Pharmacy opened a 45-day comment period October 23, 2026, on its Self-Assessments and Standard of Care proposal. Written comments must arrive by December 7. No hearing is scheduled, but the Board will hold one if a written request arrives at least 15 days before the comment period closes.12

The package would repeal specified self-assessment regulations and prescriptive furnishing protocols. The Board explains that AB 1503, effective January 1, already placed self-assessment duties in statute and established the standard-of-care approach. The pending regulatory cleanup should therefore be distinguished from the earlier statutory change.23

Connect each proposed deletion to continuing authority

Chad’s analysis: Map each proposed deletion to the authority that continues to govern the service. Use that crosswalk to review internal procedures, competency expectations, documentation, and escalation criteria. Preserve practical safeguards that support sound judgment. Submit focused comments where removing prescriptive language could leave uncertainty about implementation, and confirm the adopted text and effective date before revising controls.
