Supreme Court Requests Mississippi’s Response in 340B Contract Pharmacy Challenge

On October 27, the Supreme Court requested Mississippi’s response in Novartis v. Fitch, a pending challenge to the state’s 340B contract pharmacy law. The deadline is November 27, 2026. Fitch had waived a response on October 20. Novartis argues that federal law preempts the state’s requirements. The new docket entry advances briefing without granting review, a stay, or other relief. The company’s request for Supreme Court consideration remains pending.

What the docket shows

On October 27, 2026, the Supreme Court requested Mississippi Attorney General Lynn Fitch’s response in Novartis Pharmaceuticals Corp. v. Fitch, No. 26-457, setting November 27 as the deadline. Fitch had waived her right to respond on October 20. The latest entry addresses briefing. It grants neither review nor a stay or other relief.1

Novartis filed its petition on October 2. The company challenges Mississippi H.B. 728’s protection of 340B contract pharmacy arrangements and argues that state requirements expanding manufacturers’ federal program obligations violate the Supremacy Clause. Those propositions are the company’s legal arguments, which the Court has not resolved in this proceeding.12

What pharmacy leaders should watch

Chad’s analysis: Treat November 27 as a litigation monitoring milestone. Track the state’s filing, any revised briefing schedule, and an actual decision on review before changing financial forecasts or contract assumptions. Keep Mississippi’s dispute distinct from challenges involving other states. Operational decisions should continue to follow applicable law and governing orders, with the scope of each development checked before applying it to a particular pharmacy arrangement.
